Your statement should include what led to the Department of Motor Vehicles advising you that your driving privilege has been or would be suspended. It is beneficial in order to protect your driving privilege that you also provide us with your driving record including any prior convictions on your DMV record, including all moving violations, reckless driving, DUI or driving on a suspended license as well as any other criminal record you may have.

If you have received a notice that your California Drivers License was or is going to be suspended, we have to know exactly when and how you received the notice. Was this notice received by certified mail, in court, or were you informed by a police officer?

In addition our clients must prepare a List of Witnesses, List of Character References and a Social History. These critical documents are explained below.

Under social history, we ask all clients to explain exactly why losing their driving privilege would be a major hardship, including:

  • How far you drive each day from home to work?
  • Where else do you drive your vehicle (besides work) and for what purposes?
  • Do you need your driving privilege for medical appointments, religious meetings, or other necessities?
  • Do you take your children to school?
  • Do you take parents or other loved ones to/from places?
  • Are you the only licensed driver in your home?
  • How will this impact your family financially if you lose your driving privilege?
  • Are there other people who are capable of providing you with transportation?
  • Does your job require that you drive as part of your employment duties?

Provide a list of witnesses that will be willing to provide a statement on your behalf as to the current legal matter. The specific areas where we will want to receive information include:

  1. Why the police officer stated that he stopped you and what legal grounds there may have been for the stop.
  2. How you were provided actual notice that your driving privilege was or is going to be suspended.
  3. A statement as to why the loss of your driving privilege will create a major hardship for you and your loved ones.
