Physical Evaluations

People who have certain physical conditions and/or disabilities have the right to drive. But they do run the risk of losing their driver's license if their poor driving record can be attributed to their physical condition or disability. If a person commits several traffic violations in quick succession or has a record of causing auto accidents, then he or she may face a California DMV license revocation or suspension.

Once the DMV is aware that you have a physical or medical condition that may cause a potential driving risk to yourself or others, or if your driving record indicates negligent driving activity, the DMV may do one of the following:

  • Request medical information from you. If that is evidence enough that you do not present a driving risk, DMV's evaluation may end and no action will be taken against your driving privilege.
  • Conduct a regular reexamination, which may be in-person or conducted over the telephone. You may be asked to present medical information and submit to a law, vision and driving test.
  • Conduct a "Priority Reexamination." If you were served with a Notice of Priority Reexamination, you must appear for the reexamination within five days. If you fail to appear, your driver's license will be suspended. You will be required to submit to a law, vision and driving test and present medical information.
  • Take immediate action. If a DMV official determines that your physical condition presents an immediate threat to public safety, your license may be immediately suspended or revoked.

The DMV is required to conduct a physical evaluation of the person. During this evaluation, a DMV officer will evaluate the person's physical capabilities. If the person does not pass the physical exam and if the DMV officer determines that the person does not have the physical ability to operate a motor vehicle, then the DMV will likely suspend or revoke the motorist's driving privilege.
