Habitual Drug Use

If you have been convicted of three or more drug-related offenses within a three-year period, then the California Department of Motor Vehicles (DMV) could label you a "habitual drug user" and consequently suspend your driving privilege.

You can fight that potential suspension by requesting a hearing with the DMV and present evidence that the action is not warranted. The DMV will want to see a current substance abuse evaluation from your substance abuse counselor, dated not more than three months before the hearing date.   • Their knowledge of your past and current involvement in a treatment and/or support group
