Habitual Alcohol Use

If you have been arrested and convicted on repeated DUI violations, then the California Department of Motor Vehicles (DMV) has the authority to revoke your driving privilege. When a driver's license is revoked, it is for a minimum of one year for a first revocation and a minimum of five years for a subsequent revocation within seven years of a prior revocation.

A habitual user of alcohol or "a habitual offender" can be someone who has gotten into repeat DUI's or has had many alcohol-related offenses or has had an extraordinarily high blood alcohol concentration (BAC). For example, if you've had a BAC of more than 0.20 percent on a chemical test; if you've been convicted three or more times of alcohol-related offenses; if you've relapsed after attempting to become sober; or if you've been diagnosed by a professional as alcohol dependent.

However, if you believe that your California driving privilege has been erroneously or unfairly revoked because of prior alcohol use, then you may be able to schedule a DMV hearing to get your driving privilege reinstated. During this hearing you must be armed with information about your prior alcohol use and current sobriety. The DMV will require proof that you have abstained from alcohol or substance abuse.

It is vital that you are represented by a skilled California DMV DUI attorney at these hearings because the burden of proof in these hearings is on you - the licensee. You must present convincing evidence that:

  • Your alcohol abuse if any is under control and will continue to remain under control
  • You represent a low or minimal risk of repeating the act of drunk driving or past abusive behavior
  • You have the ability and motivation to drive safely and within the law
